16.1. CMS (Content Management System). — CreateTheWeb reserves the right to create your website on any form of CMS (content management system)/framework unless agreed otherwise.
16.2. Templates. — CreateTheWeb reserves the right to create your website using themes, templates, plugins and various other features created by third party organisations with genuine licenses. If these licenses have on-going fees, you shall receive a quotation/proposal before installation of the plugin, theme or feature.
16.3. Definition of "bespoke". — All website design services provided by CreateTheWeb are referred to as "bespoke". This includes any websites designed using themes, templates and plugins made by third party organisations. We will alter it to fit your bespoke needs.
16.4. Footer Text. — CreateTheWeb reserves the rights to place the text “UK Web Design & Marketing by CreateTheWeb.co.uk” with a link to our website, in the footer of your published website – This can be discussed for removal beforehand. If we find that you have removed this without consulting with us, you may be subject to pay a fee of up to 200% of the total value of your project.
16.5. Our time frame. — We are obliged to complete the first draft of your website within 12 months after we explicitly agree to begin (we keep an average time of 2-6 weeks, for business reputation goals). This does not apply if the client causes a delay on the completion of the draft.
16.6. Publishing without payment. — CreateTheWeb reserves the rights to not index your website to Google or publish your website live until full payment has been made.
16.7. Website restrictions & functionality. — Your website account may have limited functionality depending on your website and CMS. This can be changed for a fee. Please ask about this before going ahead with a website if you are concerned. We will provide you with the features we believe are needed for your use case.
16.7. Website changes/revisions. — We will propose a specific number of website revisions/changes in a pricing proposal. If we have not presented you with a distinct number of revisions that we will provide for your website design service, we will stop all additional free revisions when we conclude that the website is at a completed state. This is down to our conclusion, not the client's.
16.8. Old website backup. — You are responsible for taking and keeping a backup of your old website, if you have one, as we will not take a backup/archive of your old website.
16.9. Guides and advice. — We will agree on a price for video and text guides on how to edit and use your website. We will also offer 1to1 live sessions for a set price.
16.10. Revisions/changes after your website is complete. — If you have used all of your free revisions, we will provide you with a quotation/proposal with a price to fulfil your further requested revisions/changes.
16.11. Changes that you make. — We are permitted to invoice for any work that involves us fixing any issues that the client makes by editing the website themselves. We are also permitted to invoice for any work where the client would like us to make changes to any area of the website that they have edited themselves.
16.12. Website issues and maintenance. — Unless you have a website support/maintenance package, we provide you with 60 days of free issue fixing if you encounter any problems with your website. After 60 days, you are responsible for the security, licences, up keep and health of your website.
16.13. WordPress security & updates. — We install the latest version of all available plugins when designing your website. But, you will not receive on-going plugins and software updates unless you use one of our website maintenance packages. This also applies to website security, if you do not have a maintenance package, you are responsible for monitoring your website security. If you were to get hacked or experience any issues, you are required to pay for our time to fix the website if you do not have a website maintenance package.
16.14. Final 50% of your deposit deadline. — You are required to pay the final 50% of your agreed website cost if you do not provide any amendments within 30 days of receiving your first draft.
16.15. Additional licenses after completion. — If your website requires additional licences after we have completed it, you are required to pay and configure them. We are happy to provide a proposal to install them for you if you need us to.
16.16. Webflow CMS design limitations. — If we design your website on Webflow, you will be limited to very basic design updates. If you cannot update something through the control panel we provide you with, you must request a proposal from us to perform the updates for you.
16.17. When paying your website gradually, the following terms apply until your website has been paid in full;
16.18. Extra charges for repayment programmes (monthly instalment payments). — We do not charge any interest for gradual repayments, but we do charge an upfront administration fee between £100 and £250 for gradual payment plans.
16.19. Cancelling your payments/plan for repayment programmes (monthly instalment payments). — If you cancel your monthly payments or choose to cancel your plan/package, we will take your website offline until the service is paid for and restarted again.
16.20. Website ownership. — We will retain the ownership of your website and give you a license to use it on your domain.
